Throughout these Terms talentaction.com and TalentAction are interchangeable in their identification of said company.

You must be 18 years old or older to use this website. If you are under the age of 18, you are not permitted to use talentaction.com or access content, features, and benefits on this website. Although, you may have a parent, guardian or representative (over 18 yrs.) to do so. In that they are in control of every correspondence and review; in case of any such correspondence should contain material inappropriate for anyone under the age of 18 yrs.

By using talentaction.com you agree you have read, understand and agree to the Terms of Service. We reserve the right, at our sole discretion, to change, modify, add, or delete portions of these Terms of Service at any time without notice. User Conduct
You understand that talentaction.com is available for your personal use only. You represent, warrant, and agree that no materials of any kind submitted will violate or infringe upon the rights of any third party, including copyright, trademark, privacy, publicity or other personal or proprietary rights; OR CONTAIN LIBELOUS, DEFAMATORY, OR OTHERWISE UNLAWFUL MATERIAL. You further agree not to harvest or collect email addresses or other contact information of talentaction.com users or the Site by electronic or other means for the purposes of sending unsolicited emails or other unsolicited communications. Additionally, you agree not to use automated scripts to collect information from the Site or for any other purpose. You further agree that you may not use the Site in any unlawful manner or in any other manner that could damage, disable, overburden, or impair talentaction.com and its users. In addition, you agree NOT to use talentaction.com to:

  • upload, post, email, transmit, or otherwise make available any content TalentAction deems to be harmful, threatening, abusive, harassing, vulgar, obscene, hateful, or racially, ethnically, religiously or otherwise objectionable or violative of any laws;
  • impersonate any person or entity, or falsely state or otherwise misrepresent yourself or your affiliation with any person or entity;

  • upload, post, email, transmit, or otherwise make available any material that contains software viruses, etc. or any other computer code, files, or programs designed to interrupt, destroy, or limit the functionality of any computer software or hardware or telecommunications equipment;
  • manipulate identifiers in order to disguise the origin of content transmitted through the service;
  • intimidate, stalk or harass another user;
  • exploit people in a monetary, sexual or violent manner;
  • use or attempt to use another user, or service to create a false identity on talentaction.com, that includes personal or identifying information about another person without that person's explicit consent;
  • attempt for anything that is false, deceptive, misleading, deceitful, misinformative, or constitutes "bait and switch";
  • advertise any illegal service or item of which is prohibited or restricted by any applicable law;
  • contact anyone who has asked not to be contacted;

Postings
You are responsible for maintaining the confidentiality of your post(s) and are fully responsible for all activities in perpetuity that occur with your post(s). You agree to immediately notify talentaction.com of any unauthorized use or any other breach of security.

Therefore you acknowledge that all posts/requests/replies made express the views and opinions of the author/submitter/user and not the administrators, moderators or webmaster, and hence will not be held liable.

TalentAction has/reserves the right to refuse, edit and/or delete any request/listing/post it receives. Especially those that reveal any behavior that TalentAction believes might harm its name or reputation or even the name or reputation of its affiliates or users.

Postings are provided for your convenience and do not constitute an endorsement by talentaction.com.

TalentAction operates as an online service provider, and will not be held liable as “publishers” of “self published” content submitted by its users.      Top of page

Expiration Policy
Postings will remain on Site as outlined on posting rules pages and Help section. Unless you elect to delete or otherwise are in violation of terms, your post will remain for the full duration. TalentAction does not and will not reimburse any flags/removals or be held responsible for any loss(es) as a result thereof. (see Flagging).      Top of page

Posting Agents
A "Posting Agent" is a third-party agent, service, or intermediary that offers to post Content to the Service (applies to free Job section only) on behalf of others. To moderate demands on TalentAction's resources, you may not use a Posting Agent to post Content to the Service (free Job section only) to facilitate posting Content on behalf of others.

You agree that TalentAction, in its sole discretion, has the right (but not the obligation) to delete or deactivate your account, block your email or IP address, or otherwise terminate your access to or use of the Service (or any part thereof), immediately and without notice, and remove and discard any Content within the Service, for any reason, including, without limitation, if TalentAction believes that you have acted inconsistently with the spirit of the Terms. You also agree that TalentAction shall not be liable to you (monetarily or otherwise) or any third-party for any termination of your access to the Service. Flagging/Blacklist
This check and balance system is set in place in attempts to identify postings that violate terms. A "community watch" system empowers users to help identify violators, by using this flagging system.

If a posting violates terms it will be removed immediately with (or without) formal notification to you. It takes more than one flag (per user) to affect a single posting. Posts that are repeatedly flagged are subject to staff review and additional remedial actions. Remedial actions can amount to being "blacklisted" from any future posting, etc. Notwithstanding, users who violate rules for contacting a poster. See Help section for these topics.

This self governing system, although not perfect, will at times result in postings (possibly) being wrongfully flagged. If you feel you have been wrongfully flagged, you are provided an opportunity to repost. But you will first need to follow posting guidelines/rules as outlined on posting pages and the Help section.

TalentAction WILL NOT respond to any inquiries about flags, NOR will it honor any refunds as a result thereof.      Top of page

Content
You understand that all postings, messages, text, images, photos, video, sounds, or other materials "Content" posted on, transmitted through, or linked from the Service, are the sole responsibility of the person from whom such Content originated. More specifically, you are entirely responsible for each individual "Item" of Content that you post, email or otherwise make available via the Service. You understand that TalentAction does not control, and is not responsible for Content made available through the Service, and that by using the Service, you may be exposed to Content that is offensive, indecent, inaccurate, misleading, or otherwise objectionable.

Furthermore, the TalentAction Site and Content available through the Service may contain links to other Sites, which are completely independent of TalentAction. Your linking to any other websites is at your own risk.

You agree that you must evaluate, and bear all risks associated with, the use of any Content, that you may not rely on said Content, and that under no circumstances will TalentAction be liable in any way for any Content or for any loss or damage of any kind incurred as a result of the use of any Content posted, emailed or otherwise made available via the Service. No Spam Policy

Unauthorized use of TalentAction computer systems is a violation of the Terms and certain federal and state laws. We are not responsible for, nor have any control over the privacy policies of those third party websites, and encourage all users to read the privacy policies of each and every website visited.

    Data stored

  • Users can access, edit, delete or renew their post information through the Edit or Renew section.
  • Although we make good faith efforts to store the information in a secure operating environment that is not available to the public, we cannot guarantee complete security.

    Archiving and display of TalentAction postings by search engines and other sites

  • Search engines and other sites not affiliated with TalentAction may possibly make available TalentAction postings.
